Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the platform and services provided by Point11 Solutions LLC (“Provider”). This AUP is incorporated into and forms part of the Master Services Agreement (the “Agreement”). Capitalized terms not defined herein have the meanings given in the Agreement.
1. General Prohibitions
You shall not use the Platform or Services, or permit them to be used, to:
- Generate, process, store, or distribute content that is unlawful, defamatory, obscene, harassing, threatening, or that promotes violence, discrimination, or hatred
- Create deepfakes, synthetic media, or AI-generated impersonations of real individuals without their explicit, documented consent and in compliance with applicable law
- Generate content designed to deceive, mislead, or manipulate individuals or public opinion, including disinformation campaigns or fraudulent communications
- Process or store protected health information (PHI) without executing a HIPAA Business Associate Agreement with Provider
- Process or store payment card data in violation of PCI DSS requirements
- Engage in unauthorized surveillance, facial recognition, or biometric profiling
- Generate content that sexualizes minors or facilitates child exploitation in any form
- Attempt to extract, reverse-engineer, or reconstruct Provider's AI/ML Models, training data, or proprietary algorithms through systematic querying, model inversion, or other techniques
- Send unsolicited bulk communications (spam) through the Platform
- Interfere with or disrupt the integrity or performance of the Platform or any other user's access
- Violate any applicable law, regulation, or third-party right
2. AI-Specific Requirements
Where you use AI/ML features of the Platform, you shall:
- Maintain meaningful human oversight of AI-generated outputs used in high-stakes decision-making, including employment, credit, insurance, healthcare, or criminal justice decisions
- Clearly disclose to end users when they are interacting with AI-generated content or AI-powered agents, as required by applicable law (including, where applicable, the EU AI Act or similar regulatory frameworks)
- Independently assess whether your use of the Platform triggers deployer or operator obligations under applicable AI governance laws
- Maintain records of AI system usage as required by applicable regulatory requirements
- Review AI-generated outputs before publication, distribution, or use in decision-making, and take responsibility for all outputs you choose to use
3. Product-Specific Requirements
Your use of specific Services is subject to the product-specific obligations set forth in the Agreement, including:
Agentic Commerce & MCP Server (Agreement Section 2.14)
- Implement transaction velocity limits, spending caps, and fraud detection controls
- Ensure all Agent Transactions provide end users with clear confirmation, cancellation, and refund mechanisms
- Do not configure AI agents for deceptive pricing, bait-and-switch tactics, or dark patterns
- Ensure all MCP Data is accurate, current, and does not contain misleading pricing or availability information
- Comply with consumer protection laws, payment network rules, and financial services regulations
On-Site AI Agents — Chat & Voice (Agreement Section 2.15)
- Obtain all legally required consents for voice recording and biometric data collection (including BIPA, CCPA, and applicable two-party consent laws)
- Disclose to end users at the start of each voice interaction that they are communicating with an AI-powered agent
- Provide opt-out mechanisms for recording and access to live human agents
- Monitor chat agent responses for accuracy and compliance
Google Ads Management (Agreement Section 2.16)
- Ensure all products, services, and landing pages comply with Google's Advertising Policies
- Comply with FTC endorsement guidelines and industry-specific advertising regulations
- Do not promote illegal products or services through the Platform
Violation of any product-specific obligation constitutes a violation of this AUP.
4. Reporting Violations
If you become aware of any violation of this AUP, please report it to legal@point11.com.
5. Enforcement
Provider reserves the right to investigate potential violations of this AUP. If Provider reasonably determines that a violation has occurred or is imminent, Provider may:
- Request that you remediate the violation within a specified timeframe
- Temporarily suspend your access to affected Services
- Permanently terminate your access in accordance with the Agreement
Provider shall provide written notice of any enforcement action, except where immediate action is necessary to prevent imminent harm, legal liability, or disruption to other customers. Provider shall work with you in good faith to resolve issues prior to suspension or termination.
6. Changes to This AUP
Provider may update this AUP from time to time to address emerging AI use cases, regulatory changes, or security threats. No update shall materially diminish your rights under the Agreement. Provider shall notify you at least thirty (30) days in advance of any material changes.
